Rents are rising again, making it hard to find an apartment
Inevitably, the unemployment rate has sky-rocketed, leaving many renters, legislators, and multifamily operators worried about rent. President of the National Multifamily Housing Council, Doug Bibby, recently wrote an opinion piece making a plea for renters to be accountable and make their payments to prevent a potential housing catastrophe.
Paying rent ultimately keeps people in their homes by ensuring housing providers can meet their own financial obligations and keep the entire apartment community afloat in these troubling times. Many apartment operators are working hard to support renters in making their payments, and devising creative solutions to keep reliable residents in place. How are top operators ensuring those financially impacted by COVID will receive the necessary rent relief?
And how are they providing that rental support to better safeguard their entire community? NAA has also released a set of best practices on rent collection amid COVID, including templated forms for a payment plan agreement and notice of temporary waiver of late fees. Lincoln Property Management, for example, mentioned in a letter to its residents that rent relief efforts included payment plan options and other policies designed to alleviate financial burdens for those affected.
In addition, Irvine Company froze rents and renewal increases through June 1, , is offering short-term lease extensions, and temporarily halted all eviction activity through June 1, Essex is another operator that allows renters to fill out a request form if they have a COVID related financial hardship that inhibits their ability to pay rent.
RAM Partners made a statement asking those experiencing financial hardship to reach out to their community manager to discuss options. AvalonBay outlined new options to help renters through financial hardship, including account credits, flexible transfers without penalty, and payment plan options. The Bainbridge Companies has contacted all their residents to discuss alternative payment plans and is waiving late fees for those who experienced financial loss as a result of COVID, and has paused rent increases.
They have also shared valuable resources for residents seeking assistance. Bridge will also not pursue eviction filings for the non-payment of rent during the pandemic. Unique Rental Assistance Initiatives Village Green has implemented its Exclusive Frontline Program which grants move-in discounts for renters who are members of the essential workforce.
By waiving move-in fees and deposits for those working on the frontline, Village Green is proactive in supporting the essential workforce. The fund intends to provide financial assistance for living expenses like food, utilities, medical expenses, childcare, insurance, or transportation. Alliance Residential created a hub for federal, state, and local resources including government relief programs and COVID resident resources.
FPI Management also has a list of government resources specifically addressing wage replacement. BH Management Services created a COVID Resource Page with links to unemployment materials, economic impact payment information, coronavirus information by state, and links to local Florida resources.
Pegasus Residential created a one-sheet detailing how the government can help those concerned about rent. It outlines information on direct payments and enhanced unemployment benefits.
In the NMHC resource center, operators can find helpful templates for communicating with residents regarding rent flexibility, federal assistance, and rent obligations. The NMHC also released a document that aims to help residents understand the newly passed federal resources available to help them meet their financial obligations and it can be customized by apartment operators. In their March 13th letter to the House and Senate , they called upon lawmakers to provide direct financial assistance to renters.
Nearly a month later, the two organizations sent another letter to Congress regarding COVID Relief Phase 4 which called out the need for additional relief and stimulus legislation, including help for rental housing providers, housing professionals, and residents.
We will continue to monitor this bill and provide updates as we learn more. The more resources we share in times of uncertainty, the better off all our communities will be. One thing is certain: the more information we share in challenging times, the better off all of our communities will be.
You can look up the code sections listed on www. You should also take pictures and document the conditions. Most tenants start by talking with the landlord about the problems while they are paying the rent.
Tenants should also cooperate reasonably with repairs during business hours or during any emergency. Tenants may waive their rights to a hour notice of entry for repairs in order to get the listed problems fixed faster. What is a livable tenantable condition? Just because one of these conditions exists does not mean a unit is not livable. The court will look to see if it substantially lacks these conditions.
What can a tenant do if their unit is uninhabitable? There are five general options for the tenant, but all require giving notice of the problems to the landlord first. It is better to do this in writing.
Move Out. Wait a reasonable time after giving notice for the landlord to do the repairs and move out. Help Calling Attention to the Problem. A tenant is under no duty to move out of a rental unit in order to claim it is uninhabitable. Just because a tenant remained in a rental unit does not mean that the unit was therefore habitable.
Many tenants do not have the resources to move quickly, and there is a severe shortage of decent affordable housing. Other remedies can help spur the landlord to repair. The tenant may call the local city code enforcement inspectors and health department for an inspection of the rental unit. Tenants can ask their neighbors in other units if they want to be inspected at the same time.
Repair and Deduct. Pay to have plumbers, electricians or others to make the needed repairs that are listed in Civil Code Section Then deduct the repair cost from the rent by submitting a copy of the bill together with the remaining rent due. Withhold Rents. But it is not like a light switch; it is not all-or-nothing. If the landlord is in breach of habitability, the tenant remains obligated to pay only the amount of rent that would be reasonable taking into account the defective conditions shown in court.
Fair Housing staff can assist, but do not make this decision. The tenant should save all unpaid rents so that they can pay the rent that may be found owing by the court. The tenant and landlord may also negotiate the rent due while repairs are completed. Sue for Damages. Tenants can sue their landlords for damages including a retroactive reduction in rent and the annoyance and inconvenience of living in bad conditions.
All of the cases from the same building can be set for hearing at the same time. Because there is no rent control in Orange County a landlord can raise a tenants rent as much and as often as they wish, so long as they give proper notice of the change in terms. For more information regarding proper notice, please see the section on defective notices. What should a tenant do if they cannot pay the rent? If a tenant knows in advance that they will be unable to google web apps their rent, due to a temporary situation, they should talk to their landlord immediately to work out an arrangement with the landlord.
If the tenant is unable to make arrangements with the landlord to delay the rent payment then the tenant should make arrangements to vacate the unit as soon as possible, giving the landlord written notice. A tenant can be held responsible for paying the rent for a full day notice period whether or not they are in the unit. A landlord may be willing to waive the day notice if they can avoid a possible eviction. A landlord is not required to provide housing for those who do not pay the rent.
It is better for the landlord and tenant to avoid legal eviction proceeding if at all possible. What can a landlord do if a tenant fails to pay the rent on time? A landlord should talk to the tenant if at all possible to see if suitable arrangements can be made for the payment of rent. If arrangements cannot be made then the landlord can give the tenant a 3-day notice to pay rent or quit. This notice gives the tenant 3 days to pay the rent. You count the days beginning the day after the tenant is served with the notice.
The landlord should keep the original notice. If the tenant fails to pay within the 3 days, the landlord can file an Unlawful Detainer complaint or eviction against the tenant in Superior Court. Can a landlord lock a tenant out for not paying rent? A landlord may never lock a tenant out of their apartment. Also, a landlord may not shut off utilities or other services for failure to pay rent or any other reason.
Actions such as these by a landlord will give the tenant the right to sue the landlord for committing a self-help eviction.
A tenant may be locked out by the Marshall if the landlord wins the Unlawful Detainer Action in court. Can an oral agreement be enforced? Yes, an oral agreement can be enforced. A tenant is responsible for paying rent even if no written agreement exists.

The terms of the agreement is controlled by the California Civil Code. Which is better, an oral or written agreement? Other times, a tenant might be better off with no written contract if the terms of the contract are very slanted in favor of the landlord. Most of the time, it is better to have a contract in writing to help avoid potential conflicts. This way, each person knows his or her rights and responsibilities. Landlords and tenants should keep a copy of their written agreement handy to refer to it when they have questions.
Can a landlord change the terms of a rental agreement? Yes, with proper notice. A landlord may change any of the terms of the agreement such as: rent increase, increase security deposit, add or delete services or amenities, and terminating the tenancy. What is proper notice? Proper notice depends on the terms of the agreement. Most agreements require a day written notice. Mayor Christina Shea and her Republican majority on the City Council have claimed that our renter residents do not need these protections.
But we know from thousands of emails, social media posts, and demonstrations in the streets, that our renter residents are pleading with us for help in this crisis. We should stop ignoring their voices and enact meaningful protections for renters immediately. First, we need to 1 approve the basic protections that I called for in March and to order an enforceable moratorium on evictions and rent increases. Our renters are entitled to peace of mind about not being forced out of their homes because of the COVID19 crisis.
